In these Terms, “we”, “us” and “our” mean Francesca Beth McIntyre trading as Rascal K9s. “You” and “your” mean the person making the booking and the dog’s owner. “Session” means an individual Walk & Train appointment.

1. Service description and suitability

1.1. Walk & Train is a structured training service in which we collect, handle, walk and train your dog without you accompanying us. Training focuses on the goals agreed with you and is more than an ordinary dog walk.

1.2. An initial 1:1 assessment with the owner present is required before Walk & Train begins, unless we confirm in writing that an equivalent assessment has already been completed. The assessment does not guarantee that Walk & Train will be suitable.

1.3. We may recommend further 1:1 work, different safety arrangements or another service before accepting or continuing Walk & Train where this is reasonably necessary for safety, welfare or training effectiveness.

1.4. Sessions are normally approximately 45 minutes unless the booking confirmation states otherwise. The confirmed duration will state whether collection and return time is included.

1.5. We will provide the service with reasonable care and skill. Nothing in these Terms affects your statutory rights.

2. Bookings, packages and payment

2.1. A booking or package is confirmed only when we have accepted it, received full payment unless otherwise agreed, and sent written confirmation. Appointments are not held without payment.

2.2. The price, number of sessions, duration, service area, any travel charge, package validity period and what is included will be provided before booking. All prices are in pounds sterling (£). We are not VAT registered unless we tell you otherwise.

2.3. Package sessions must be arranged subject to availability. A package is for the dog named in the registration form and cannot be transferred to another person or dog without our written agreement and any necessary assessment.

2.4. The contract is formed when we confirm that payment has been received and the booking or package is secured.

3. Statutory cancellation rights

3.1. If you book online, by telephone, by email or away from our business premises, you will normally have a legal right to cancel the contract within 14 days after the day the contract is formed, subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

3.2. To exercise this right, tell us clearly before the cancellation period expires. You may email hello@rascal-k9s.co.uk or contact via phone 07833405886

3.3. If you ask us to begin a session or package during the 14-day cancellation period and then cancel before it has been fully performed, you must pay a proportionate amount for the service supplied up to the time you told us you wished to cancel.

3.4. Once the service has been fully performed following your express request to begin during the cancellation period and your acknowledgement that the right to cancel will be lost on full performance, the statutory right to cancel will end, where the law permits.

4. Client cancellations, rescheduling and packages

4.1. The statutory rights in section 3 take priority over this section.

4.2. If you need to cancel or rearrange a scheduled session, please give at least 48 hours’ notice by email or message. Where at least 48 hours’ notice is given, one transfer to another available appointment may be offered.

4.3. If less than 48 hours’ notice is given, we may deduct the session from a package or retain or charge an amount up to the session fee, but only to reflect the direct loss reasonably caused. We will take account of any costs avoided and whether the appointment is refilled.

4.4. If you cancel the remainder of a prepaid package after any statutory cancellation period, any refund will take account of sessions already supplied and the direct loss reasonably resulting from cancellation. Any package discount may be recalculated against the standard price of sessions already used, provided this was made clear before booking and does not produce an unfair or excessive charge.

4.5. We may consider a genuine emergency or exceptional circumstance fairly, but this does not create an automatic entitlement to a refund or transfer.

5. Cancellations and changes by Rascal K9s

5.1. We may rearrange, relocate, shorten or adapt a session because of trainer illness, severe weather, unsafe conditions, access problems, dog illness or distress, or another matter affecting safety or welfare. We will give as much notice as reasonably possible.

5.2. Where a session has begun and is reasonably adapted or shortened for the dog’s welfare or because of information or circumstances outside our control, no automatic refund is due, but we will consider the circumstances fairly.

5.3. If we cancel before providing the session and cannot offer a suitable replacement, you may choose a refund or credit for that session.

6. Collection, property access and return

6.1. You authorise us to enter the agreed part of the property, collect the dog and return the dog using the arrangements recorded in the registration form or otherwise agreed in writing.

6.2. You must provide accurate instructions and safe, lawful access, including details of keys, key safes, alarms, other animals, visitors and any person expected at the property. You must tell us promptly about any change.

6.3. Keys and access codes will be stored securely, used only to provide the agreed service and not labelled with the full property address. Lost keys or suspected compromise will be reported promptly.

6.4. You authorise unattended return only where this is expressly selected in the registration form or agreed in writing. You must provide a secure return location, suitable water and any necessary confinement instructions.

6.5. If we cannot safely access or return the dog because instructions are inaccurate, access fails, an unauthorised person or animal is present, or the premises are unsafe, we will try to contact you. The appointment may be treated as provided or late-cancelled to the extent this reflects our reasonable time and direct loss.

7. Transport

7.1. We may transport your dog only where transport has been specifically agreed. This is not blanket authority to transport the dog on every session.

7.2. Where transport is agreed, we will use reasonable care and suitable restraint or containment. We may refuse or stop transport if the dog, vehicle, equipment or conditions create an unacceptable safety or welfare risk.

7.3. You must tell us about travel sickness, distress, guarding, escape behaviour or any medical restriction affecting transport.

8. Health, behaviour and legal information

8.1. Before the first session, you must provide complete and accurate information and promptly report any change, including:

  • veterinary details, insurance information and an emergency contact;

  • medical conditions, allergies, pain, injury, mobility restrictions, medication and relevant veterinary advice;

  • recent coughing, vomiting, diarrhoea, parasites or other potentially infectious symptoms;

  • bites, attempted bites, reactivity, aggression, resource guarding or handling sensitivity;

  • escape history, chasing behaviour and reliability around people, dogs, livestock and traffic; and

  • any legal restriction, control requirement, muzzle requirement, licence condition or other matter affecting lawful handling.

8.2. The dog must be appropriately vaccinated and treated for parasites as advised by its veterinary surgeon, in general health and fit for the agreed activity. Proof may be requested where reasonably necessary.

8.3. You must not present a dog for collection if it is unwell, injured, potentially infectious or not fit for the planned activity without discussing this with us first.

8.4. You must ensure the dog is microchipped, licensed and identified as required by Northern Ireland law, with current owner details.

9. Equipment, handling and training methods

9.1. You must provide secure, correctly fitted equipment in good condition. We may use agreed additional safety equipment, including a backup attachment, long line or muzzle, where appropriate.

9.2. Training may include food, toys, play, marker training, management, environmental changes, lead handling, reinforcement, boundaries and other methods or equipment discussed with you.

9.3. Any equipment used or recommended must be lawful in Northern Ireland at the relevant time. We will explain its intended use and may refuse equipment or handling we consider unlawful, unsafe, unsuitable or inconsistent with the dog’s welfare.

9.4. We may walk or train the dog alongside another suitable dog only where this has been discussed and authorised and we reasonably consider it appropriate and safe.

10. Welfare, emergencies and escape

10.1. We will act reasonably in the dog’s welfare interests and may change route, avoid an environment, reduce activity, shorten a session or stop where the dog appears unwell, injured, overly distressed or unsafe to continue.

10.2. If the dog becomes ill or is injured, we will try to contact you and the emergency contact. If neither can be reached and we reasonably consider urgent veterinary advice or treatment necessary, you authorise us to contact the nominated veterinary practice or, if unavailable, another suitable veterinary provider and to arrange treatment within the authority and spending limit recorded in the registration form.

10.3. You are responsible for reasonable veterinary and related costs unless the need for treatment was caused by our failure to use reasonable care and skill. A veterinary professional remains responsible for clinical decisions.

10.4. If the dog escapes or becomes missing, we will take reasonable immediate steps to recover it, notify you and, where appropriate, contact relevant authorities or local services. We will not delay urgent action solely because you cannot be reached.

11. Feedback and training outcomes

11.1. We will provide a brief update after each session, which may include written feedback and private video demonstrating training where consent has been recorded.

11.2. Training results and timescales cannot be guaranteed. Progress depends on factors outside our control, including health, temperament, history, environment and the consistency with which recommendations are followed between sessions.

11.3. Walk & Train supports training but does not replace owner participation. You remain responsible for managing the dog and practising agreed skills outside sessions.

12. Risks and liability

12.1. Handling, walking and training dogs involves inherent risks, including pulling, scratches, bites, falls, escape, traffic and interactions with people, animals or the environment. We will take reasonable precautions to reduce these risks.

12.2. We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and liability that cannot lawfully be excluded or limited. Nothing in these Terms affects your statutory rights.

12.3. Subject to clause 12.2, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss or damage that was not reasonably foreseeable.

12.4. You are responsible for reasonably foreseeable loss or damage caused by your failure to provide accurate information, supply safe equipment or access, comply with these Terms, or disclose a relevant health, behaviour or legal risk.

12.5. You are encouraged to maintain suitable pet insurance, including third-party liability cover where available.

13. Personal data, keys and media

13.1. We use registration, access, veterinary, emergency-contact, session and case-note information to administer and provide the service. Personal information will be handled in accordance with our Privacy Notice: https://rascal-k9s.co.uk/dog-training-privacy-notice

13.2. With consent recorded on the registration form, we may take photographs or short videos for assessment and private training updates to you.

13.3. We will not use identifiable photographs, videos or case details for advertising, our website or social media unless you have given separate, optional marketing consent. Refusing or withdrawing marketing consent will not affect the service.

14. Training materials

14.1. Handouts, plans and videos we provide are for your personal use with the dog covered by the booking. You must not sell, publish or distribute them publicly without written permission, except where the law allows.

. Complaints and general terms

15.1. If you are unhappy with the service, contact us promptly at hello@rascal-k9s.co.uk or 07833 405886. We will acknowledge the complaint and aim to respond fairly within a reasonable time. This does not prevent you seeking advice from Consumerline or exercising a legal right.

15.2. Before payment is taken, you will be given access to these Terms and asked to confirm agreement. We will provide confirmation in a form you can keep, such as email or a downloadable document.

15.3. We may update these Terms, but the version accepted when the booking was confirmed will apply unless a change is required by law or you agree otherwise.

15.4. If any provision is unlawful or unenforceable, the remaining provisions continue to apply. No person other than you and us has a right to enforce these Terms.

15.5. These Terms are governed by the law of Northern Ireland. The courts of Northern Ireland will have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere.
