In these Terms, “we”, “us” and “our” mean Francesca Beth McIntyre trading as Rascal K9s. “You” and “your” mean the person making the booking and, where relevant, the dog’s owner or handler.
1. Bookings and payment
1.1. A place is confirmed only when full payment has been received and we have sent written confirmation by email or message.
1.2. Places are allocated on a first-come, first-served basis.
1.3. Fees are payable in advance for the full course. Payment per individual class is not accepted unless we expressly agree otherwise in writing.
1.4. The course price, dates, times, duration, venue and what is included will be set out before you book and confirmed in writing. All prices are in pounds sterling (£). We are not VAT registered unless we tell you otherwise.
1.5. The contract is formed when we send written confirmation that your payment has been received and your place is secured.
1.6. We will provide the services with reasonable care and skill. Nothing in these Terms affects your statutory rights.
2. Statutory cancellation rights
2.1. If you book online, by telephone, by email or away from our business premises, you may have a legal right to cancel the contract within 14 days after the day the contract is formed. This right is subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and any applicable exemption.
2.2. To exercise a statutory right to cancel, you must tell us clearly by email or via phone.
2.3. If you ask us to begin providing the course during the 14-day cancellation period and then cancel while a statutory cancellation right still applies, you must pay a proportionate amount for the services supplied up to the time you told us you wished to cancel.
2.4. If the service is fully performed during the cancellation period following your express request to begin and your acknowledgement that the right to cancel will be lost once the service has been fully performed, the statutory right to cancel will end on full performance.
2.5. Some services relating to leisure activities on a specified date or during a specified period may be exempt from the statutory right to cancel. The application of that exemption to our fixed-date courses should be confirmed by our solicitor. Nothing in this section gives up any right you have by law.
3. Client cancellations, missed classes and transfers
3.1. Any statutory cancellation right described in section 2 takes priority over this section.
3.2. If you cancel before the course begins after any applicable statutory cancellation period has expired, we will offer a transfer to another suitable course where reasonably possible.
3.3. If a transfer cannot reasonably be offered, any amount retained by us will be limited to losses and costs reasonably arising from your cancellation, including loss caused where the reserved place cannot reasonably be filled. If we fill the place or avoid a loss, this will be taken into account when calculating any refund.
3.4. Once a course has started, missed classes are not normally refundable or transferable. Where reasonably possible, we may offer written exercises, attendance at another suitable class or a transfer, but availability cannot be guaranteed.
3.5. A course place may not be transferred to another person or dog without our prior written agreement, because suitability and safety information must be reviewed first.
4. Cancellations or changes by Rascal K9s
4.1. If we must cancel a class because of trainer illness, an unsafe venue, severe weather, an emergency or another matter outside our reasonable control, we will offer a replacement date, suitable alternative session, credit or transfer where reasonably possible.
4.2. If a suitable replacement cannot be provided, we will give a pro-rata refund for the class or classes we do not provide.
4.3. We may reschedule, relocate or merge a course where minimum numbers are not met or the venue becomes unavailable. We will give as much notice as reasonably possible and offer a reasonable alternative. If the change is significant and you cannot reasonably attend the alternative, we will offer a transfer or refund for the affected services.
4.4. We are not responsible for additional or indirect costs you incur because a class is changed or cancelled, except where the law requires otherwise.
5. Dog and owner requirements
5.1. Dogs must be appropriately vaccinated as advised by their veterinary surgeon and meet any vaccination requirements notified for the venue or course. Proof may be requested.
5.2. Dogs must not attend while they have, or may reasonably be suspected of having, an infectious illness or parasites, including kennel cough, vomiting, diarrhoea, fleas or worms. You must notify us before the class and we will discuss any transfer or alternative support that may be available.
5.3. Before attending, you must give us accurate and complete information about any matter that could affect safe participation, including:
aggression, fear or reactivity towards people or dogs;
any previous bite or serious injury incident;
medical conditions, pain, injury, medication or mobility restrictions;
whether the dog is in season or may otherwise require adjusted arrangements; and
any equipment or handling restriction relevant to the dog.
5.4. You must update us promptly if any of this information changes during the course.
5.5. Handlers under 18 must be accompanied and supervised by a responsible adult. The responsible adult remains responsible for the dog and the handler throughout the class.
6. Suitability and removal from class
6.1. Group classes are not suitable for every dog. We may adapt an exercise, ask for additional space, pause participation or ask a dog to leave where we reasonably consider this necessary for safety or welfare.
6.2. Where accurate information was supplied but the dog is not suited to the group environment, we will discuss a reasonable alternative. Depending on the circumstances, this may include a transfer, credit towards a suitable 1:1 service or an appropriate pro-rata refund for services not supplied.
6.3. Where removal results from material information being withheld, seriously unsafe conduct, or repeated failure to follow reasonable safety instructions, no refund will normally be given for services we have already provided. Any amount retained for future services will be reasonable and reflect our actual loss. This does not affect your statutory rights.
7. Equipment and handling
7.1. Dogs must arrive wearing a secure, appropriately fitted collar or harness and lead. Flexi or extending leads are not permitted during class unless we expressly agree otherwise.
7.2. You must follow reasonable safety instructions. We may refuse equipment or handling methods which, in our professional opinion, compromise welfare or create an undue risk.
7.3. We will explain any training exercise or equipment we recommend. You should tell us immediately if you do not understand an instruction or are uncomfortable carrying it out.
8. Conduct and safety
8.1. You remain responsible for handling and supervising your dog throughout the class and must follow trainer instructions and venue rules.
8.2. Dogs must remain on lead inside and around the venue unless the trainer instructs otherwise.
8.3. Children must be supervised by their accompanying adult and must not approach or handle another dog without permission.
8.4. We may ask a person to stop an activity or leave if their conduct is seriously or repeatedly disruptive, unsafe, abusive or inappropriate towards dogs, clients, venue representatives or staff. Where practicable, we will first explain the concern and give the person an opportunity to correct it.
8.5. Any refund following removal under clause 8.4 will depend on the circumstances and will be limited only to the extent reasonably necessary to reflect the services provided and our direct loss. This does not affect your statutory rights.
9. Venue and housekeeping
9.1. You must respect the venue and any notified rules, including parking only in designated areas, keeping noise at a reasonable level and leaving the space clean and tidy.
9.2. Dog waste must be picked up immediately and placed in an appropriate bin or taken away where no suitable bin is provided.
9.3. Smoking and vaping are not permitted inside the venue.
10. Risks and liability
10.1. Working around dogs carries inherent risks, including scratches, bites, falls, collisions and interactions between dogs. You agree to take reasonable care, keep your dog under control and follow safety instructions.
10.2. We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and any liability which cannot lawfully be excluded or limited. Nothing in these Terms affects your statutory rights.
10.3. Subject to clause 10.2, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss or damage that was not reasonably foreseeable.
10.4. You are responsible for reasonably foreseeable loss or damage caused by your failure to control your dog, follow reasonable instructions, comply with these Terms or provide accurate and complete safety information.
10.5. You are encouraged to maintain suitable pet insurance, including third-party liability cover where available.
11. Training outcomes
11.1. Training results depend on factors outside our control, including the dog’s health, temperament, history, environment and the consistency with which training is practised between classes. We do not guarantee a particular behavioural or training outcome.
11..2. Our services do not replace veterinary advice. You should seek veterinary assistance where pain, illness or another medical issue may be contributing to behaviour.
12. Personal data, photographs and video
12.1. We handle personal information in accordance with our Privacy Notice, which will be made available before you book: https://rascal-k9s.co.uk/dog-training-privacy-notice
12.2. With the relevant consent recorded on the registration form, we may take photographs or short videos where reasonably needed to provide private training feedback or updates. Because group-class recordings may include other people or dogs, recording will be managed carefully and is not guaranteed.
12.3. We will not use identifiable photographs or videos for advertising, our website or social media unless you have given separate, optional marketing consent. Refusing or withdrawing marketing consent will not affect your ability to use our services.
12.4. You must not photograph or record another client, child or dog without their permission and our agreement.
13. Complaints
13.1. If you are unhappy with any part of the service, please contact us as soon as possible at hello@rascal-k9s.co.uk or 07833 405886. We will acknowledge the complaint and aim to respond fairly within a reasonable time.
13.2. Nothing in this complaints process prevents you from seeking advice from Consumerline or exercising any legal right.
14. General
14.1. Before payment is taken, you will be given access to these Terms and asked to confirm that you have read and agree to them. We will provide confirmation in a form you can keep, such as by email or a downloadable document.
14.2. We may update these Terms from time to time, but the version accepted when your booking was confirmed will apply to that booking unless a change is required by law or you agree otherwise.
14.3. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
14.4. No person other than you and us has a right to enforce these Terms.
14.5. These Terms are governed by the law of Northern Ireland. The courts of Northern Ireland will have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere.
