In these Terms, “we”, “us” and “our” mean Francesca Beth McIntyre trading as Rascal K9s. “You” and “your” mean the person making the booking and, where relevant, the dog’s owner or handler.

1. Bookings, payment and session format

1.1. Sessions are by appointment only. A booking is confirmed only when we have accepted it, received full payment unless otherwise agreed, and sent written confirmation by email or message. An appointment is not held without payment.

1.2. The price, appointment time, expected duration, location, any travel charge and what is included will be provided before you book. All prices are in pounds sterling (£). We are not VAT registered unless we tell you otherwise.

1.3. The standard session length is approximately 60 minutes unless the booking confirmation says otherwise. Sessions may take place in your home, garden or an agreed public location, depending on the training goals and safety assessment.

1.4. The client or another agreed responsible adult must be present throughout the session and remains responsible for the dog. A handler under 18 must be accompanied and supervised by a responsible adult.

1.5. Any agreed follow-up plan, notes, exercises or private training videos may be provided electronically. The level of follow-up included is the level stated in the booking confirmation; ongoing support is not included unless expressly agreed.

1.6. We will provide the service with reasonable care and skill. Nothing in these Terms affects your statutory rights.

2. Statutory cancellation rights

2.1. If you book online, by telephone, by email or away from our business premises, you will normally have a legal right to cancel the contract within 14 days after the day the contract is formed, subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2.2. To cancel under this statutory right, you must tell us clearly before the cancellation period expires. You may email hello@rascal-k9s.co.uk or contact via phone.

2.3. If your appointment is due to take place during the 14-day cancellation period, we will only begin the service during that period after you have expressly requested an early start.

2.4. If you request an early start and then cancel before the service has been fully performed, you must pay a proportionate amount for the service supplied up to the time you told us you wished to cancel.

2.5. Once a service has been fully performed following your express request to begin during the cancellation period and your acknowledgement that the right to cancel will be lost on full performance, the statutory right to cancel will end, where the law permits.

3. Client cancellations, rescheduling and lateness

3.1. The statutory rights in section 2 take priority over this section.

3.2. If you need to cancel or rearrange an appointment, please give at least 48 hours’ notice by email or message. Where at least 48 hours’ notice is given, one transfer to another available appointment may be offered.

3.3. If less than 48 hours’ notice is given, we may retain or charge an amount up to the full session fee, but only to reflect the direct loss reasonably caused by the late cancellation. We will take into account any costs avoided and whether we are able to refill the appointment.

3.4. We may consider a genuine emergency or exceptional circumstance fairly, but this does not create an automatic entitlement to a refund or transfer.

3.5. If you arrive late, the appointment will normally finish at the originally scheduled time so that later clients are not affected. If you are more than 15 minutes late without contacting us, we may treat the appointment as a late cancellation where it is no longer practical or safe to provide a meaningful session.

4. Cancellations or changes by Rascal K9s

4.1. We may cancel, pause, relocate or rearrange a session because of trainer illness, severe weather, an unsafe environment, a welfare concern or another matter outside our reasonable control. We will give as much notice as reasonably possible.

4.2. If we cancel and cannot provide a suitable replacement appointment, you may choose a refund or credit for the service we did not provide.

4.3. If a public-location session cannot proceed safely because of weather or environmental conditions, we may adapt the work, move to a safer location or rearrange the appointment.

5. Information and assessment

5.1. You must provide complete and accurate information before the session and update us promptly if anything changes. This includes:

the dog’s age, breed, ownership and relevant history;

behaviour concerns, triggers, reactivity, resource guarding, escape or chasing behaviour;

any bite, attempted bite or incident causing injury to a person or animal;

medical conditions, pain, injury, medication or veterinary advice relevant to training;

previous training and equipment used;

any legal restriction, control requirement, muzzle requirement or relevant licence condition; and

any other information that could reasonably affect safety or the suitability of the session.

5.2. We may ask for veterinary assessment or clearance before proceeding where pain, illness or another medical issue may be affecting behaviour or safe participation.

5.3. Our initial assessment and recommendations are based on the information available and the behaviour observed at the time. A dog may behave differently in other places or circumstances.

6. Safety, environment and owner responsibilities

6.1. You remain responsible for supervising and controlling your dog throughout the session. You must follow reasonable safety instructions and comply with applicable law.

6.2. Before a home visit, you must provide a reasonably safe working environment and tell us about any access, parking, household, property or personal-safety issue that could affect the visit. Other animals and household members may need to be separated or managed when requested.

6.3. Dogs must be on secure, appropriately fitted equipment unless we instruct otherwise. In public places, you must comply with local rules and prevent uninvited contact with people or animals.

6.4. Children must be supervised by their accompanying adult and must not take part in handling exercises unless we consider this appropriate and the responsible adult agrees.

6.5. We may adapt, pause or end an exercise or session where we reasonably consider that continuing would create an unacceptable safety or welfare risk. Refunds or credits will be considered fairly according to the service supplied, the reason the session ended and any direct loss.

6.6. Because the owner or agreed responsible adult is present throughout, that person remains responsible for veterinary decisions and for seeking veterinary care if the dog becomes unwell or injured. This agreement does not authorise us to make non-emergency veterinary decisions on the owner’s behalf.

7. Training methods and equipment

7.1. Training may include food, toys, play, marker training, management, environmental changes, lead handling, reinforcement, boundaries and other techniques or equipment discussed with you.

7.2. We will explain the intended use of any recommended equipment or technique. You should ask questions and tell us if you do not understand or are uncomfortable with a recommendation. You will not be required to carry out an exercise you do not consent to.

7.3. Any equipment used or recommended must be lawful in Northern Ireland at the relevant time. We reserve the right to refuse any equipment, handling or method that we consider unlawful, unsafe, unsuitable or inconsistent with the dog’s welfare.

7.4. You are responsible for using equipment between sessions only as demonstrated and for checking that it remains secure, correctly fitted and in good condition.

8. Results and implementation

8.1. Training and behaviour outcomes cannot be guaranteed. Progress and timescales depend on factors outside our control, including the dog’s health, temperament, learning history and environment, as well as the consistency and accuracy of work between sessions.

8.2. We will make professional recommendations based on the assessment, but you remain responsible for deciding whether and how to implement them and for managing the dog outside the session.

8.3. Our service does not replace veterinary, veterinary-behaviourist or legal advice. You should seek appropriate professional advice where recommended or where pain, illness, medication or a legal issue may be relevant.

9. Risks and liability

9.1. Working with dogs involves inherent risks, including scratches, bites, falls, pulling, collisions and interactions with people, animals or the environment. Both parties agree to take reasonable precautions to reduce these risks.

9.2. We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and any liability that cannot lawfully be excluded or limited. Nothing in these Terms affects your statutory rights.

9.3. Subject to clause 9.2, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss or damage that was not reasonably foreseeable.

9.4. You are responsible for reasonably foreseeable loss or damage caused by your failure to control your dog, follow reasonable safety instructions, comply with these Terms or provide accurate and complete information.

9.5. You are encouraged to maintain suitable pet insurance, including third-party liability cover where available.

10. Personal data, confidentiality and media

10.1. We may keep assessment notes, session records and correspondence to administer and deliver the service. Personal information will be handled in accordance with our Privacy Notice, available before booking at: www.rascal-k9s.co.uk/dog-training-privacy-notice.

10.2. With the relevant consent recorded on the registration form, we may take photographs or short videos where reasonably needed for assessment or private training feedback to you.

10.3. We will not use identifiable photographs, videos or case details for advertising, our website, social media or another promotional purpose unless you have given separate, optional consent. Refusing or withdrawing marketing consent will not affect your ability to use our services.

10.4. You must obtain permission before recording the trainer or another person during a session.

11. Training materials

11.1. Any handouts, written plans or videos we provide are for your personal use in training the dog covered by the booking. You must not sell, publish, reproduce or distribute them publicly without our written permission, except where the law allows.

12. Complaints

12.1. If you are unhappy with any part of the service, please contact us as soon as possible at hello@rascal-k9s.co.uk or 07833 405886. We will acknowledge the complaint and aim to respond fairly within a reasonable time.

12.2. Nothing in this complaints process prevents you from seeking advice from Consumerline or exercising any legal right.

13. General

13.1. Before payment is taken, you will be given access to these Terms and asked to confirm that you have read and agree to them. We will provide confirmation in a form you can keep, such as an email or downloadable document.

13.2. We may update these Terms from time to time, but the version accepted when your booking was confirmed will apply to that booking unless a change is required by law or you agree otherwise.

13.3. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

13.4. No person other than you and us has a right to enforce these Terms.

13.5. These Terms are governed by the law of Northern Ireland. The courts of Northern Ireland will have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere.
